Yes. In accordance with the regulations of the Community of Madrid, Law 8/2023 on Cultural Heritage provides for three levels of protection:

• Conclusion Cultural Interest Assets the most relevant of the Cultural Heritage of our autonomous community.
• Conclusion Assets of Patrimonial Interest those that, forming part of the Cultural Heritage of the Community of Madrid, have a special historical or artistic significance.
• Conclusion Cataloged Goods the rest of the Cultural Heritage assets of the Community of Madrid and, in any case, the movable assets that make up the funds of museums and collections owned by the Community of Madrid.

The declaration as BIC and as BIP corresponds to the Government Council, after following the procedure provided for in the law.

The initiation of the declaration procedure as an Asset of Cultural Interest or as an Asset of Heritage Interest is always carried out ex officio by the General Directorate of Cultural Heritage. In any case, if you consider that an asset has relevance or special historical and artistic significance for its protection, you can request its declaration as a BIC or BIP by sending by record a letter to the General Directorate of Cultural Heritage. The request must be motivated and documented, so that its cultural interest can be clearly identified.

There you will also find updated lists with all the assets declared in the community.

Yes. After its initiation, the file can be consulted during the public information period provided for in Law 8/2023 on the Cultural Heritage of the Community of Madrid.

Likewise, the files of the assets already declared by the Governing Council can be consulted at any time.

Yes. The Community of Madrid has created a subsidy line for conservation and restoration actions of privately owned real estate with individual protection of Asset of Cultural Interest and Asset of Heritage Interest.

The bases of the call are published annually, indicating the requirements to qualify for aid, documentation to be presented and the amount of the subsidy.

If you are aware of risks of destruction, deterioration or loss of a cultural asset, you must notify the town hall of the municipal area where the events occurred and the General Directorate of Cultural Heritage, providing sufficient information to clearly identify its location and the risk. to which it could be subjected.

Law 8/2023 on Cultural Heritage of the Community of Madrid establishes a new regime for metal detectors in its articles 71 and 72:

• First, The use of metal detectors or other tools or techniques to locate archaeological remains is prohibited. in protected areas, with the exception of its use within research programs related to cultural and natural heritage.
• On the other hand, outside of protected cultural assets, the use of metal detectors or other tools or techniques that make it possible to locate archaeological remains, even without this being their purpose, must be authorized by the General Directorate of Cultural Heritage.

The interested person must present, for record, a request indicating the territorial scope and the date or term for the use of metal detectors or other similar techniques. The request will be accompanied by the authorization of the owner of the land. It must prove that it will be used for a purpose and in an area in which there is rationally no doubt for the Administration that it is not likely to cause damage to the archaeological heritage.

In the event of discovering an archaeological remains, either by chance, or in the course of any work or earth movement, in any case you must avoid handling, moving or collecting it.

Next, you must contact the General Directorate of Cultural Heritage indicating the time of discovery, the circumstances, the place and a description of what was found as well as, if possible, some photographs.

El Regional Cultural Heritage Council It is the main consultation body on cultural heritage matters made up of Administrations and public institutions and associations established for the defense of cultural heritage. Its functions are to study and advise on cultural heritage matters.

In the process of declaring an Asset of Cultural or Heritage Interest, the Community of Madrid may consult, among other institutions, the Royal Academy of History, the Royal Academy of Fine Arts of San Fernando, the Public Universities of Madrid , to the Higher Council for Scientific Research and to the Madrid professional associations related to the subject to request their assessment reports.

The most common Historical Heritage Commissions They are consultative bodies. Its main function is institutional collaboration between the Community of Madrid and the municipalities in matters of cultural heritage.

Most of the conferences and workshops held by the General Directorate of Cultural Heritage are recorded on video for later viewing free of charge.
